as I’ve now reiterated twice, i was referring to the “to this current day” part of the OP. i know you are having a really hard time understanding that, but i think we’re on the same page that WW2 and modern war are just a little bit different on what rules existed.

“This current day” is irrelevant in whatever sense you think you used it - WW2, Vietnam, Afghanistan, Iraq - all of them, all the time, everywhere ther are small HE rounds being used against infantry and you think they are war crimes - Americans, Russians, their allied forces… so fill your boots.
And actually - no, especially in WW1 - they took the St Petersburg convention very seriously - specifically exempting exploding and incendiary ammunition that was intended for use against aircraft and airships.
British pilots carrying Buckingham incendiaries would also carry a letter saying they were on a balloon hunting mission so they would not be tried for the crime - although infamously Albert Ball VC apparently used them with no regard for the rules - using a 1:1 mix in general air combat.
